A guarantee is something you get with electrical products incase they don't work.

Every electrical product should come with a 1 year guarantee, so I'm guessing if you don't know what one is, you only had 1 year, so scrap that idea.

I would call Nintendo of America BEFORE fixing it yourself, otherwise they probably wont help you.

1. Okay, that's my last option. I attempt to fix first, before calling Nintendo.

2.What!?

3.Yes, I use screen portectors, but I've had them for 2 years, and it's not the touch screen screwing up.

4.No, I have not.

5.No, I don't want a DS phat! O:

6.Yes, you helped.
I would actually call Nintendo before you attempt fixing it yourself, just in case you do something more to it. My assumption is that Nintendo is similar to a phone company, in that it'll help you for the product acting up on it's own, not for something you did to it.

I'd say your best bet is to call them first and see what they say about it. The worst that can happen is they can't help you.
